Apogee LA Participation Agreement & Terms of Service

Welcome
We are honored that you are considering Apogee LA for your child’s educational journey. Apogee LA is designed as a faith-centered, in-person learning community that supports homeschooling families by providing structured instruction, character development, and peer engagement grounded in biblical values.
We believe parents are the primary educators and spiritual leaders of their children. Our role is to partner with you — not replace you — in that calling.
Please read this Participation Agreement carefully, as it outlines important legal rights and responsibilities related to your child’s participation.

Participation in Apogee LA programs is expressly conditioned upon parental acceptance of this Agreement.
By enrolling your child, you agree to the terms below and provide legally binding consent on behalf of your minor child.
1. Nature of Apogee LA
Apogee LA is a supplemental in-person educational program designed to support homeschooling families.
- It is not a private school.
- It does not replace parental responsibility for homeschooling compliance.
- Parents remain solely responsible for meeting California homeschool legal requirements.
2. In-Person Participation & Assumption of Risk
Apogee LA programs occur in physical locations that may include:
- Classrooms
- Outdoor areas
- Recreational or athletic spaces
- Community facilities
Participation in in-person programs inherently involves certain risks, including but not limited to:
- Slips, trips, and falls
- Physical activity injuries
- Accidental contact with other participants
- Exposure to illness
- Equipment-related injuries
By enrolling your child, you acknowledge and voluntarily assume all inherent risks associated with in-person participation.
3. Release of Liability
To the fullest extent permitted by California law, you agree to release, waive, and discharge BGM Ventures LLC, Apogee LA, its directors, instructors, staff, volunteers, contractors, and facility providers from liability for any injury, illness, loss, or damage arising from participation in Apogee LA programs, except in cases of gross negligence or willful misconduct.
4. Indemnification
You agree to indemnify and hold harmless BGM and its representatives from any claims, damages, or liabilities arising out of:
- Your child’s participation
- Your child’s conduct
- Violation of this Agreement
5. Medical Authorization
In the event of illness or injury:
- You authorize Apogee LA staff to obtain emergency medical treatment for your child if you cannot be reached.
- You understand that you are financially responsible for any medical care provided.
- You agree to provide accurate medical and emergency contact information.
6. Health & Illness Policy
To protect all families:
- Children who are visibly ill or contagious may not attend.
- Apogee LA reserves the right to send a child home if illness is suspected.
- Parents are responsible for timely pickup.
7. Code of Conduct (In-Person)
Students are expected to:
- Treat peers and instructors with respect
- Follow safety instructions
- Refrain from physical aggression
- Use appropriate language
- Respect property and facilities
Apogee LA reserves the right to:
- Issue warnings
- Suspend participation
- Terminate enrollment without refund for serious or repeated violations
8. Parent Responsibilities
Parents agree to:
- Ensure safe drop-off and pickup
- Provide supervision outside scheduled hours
- Inform staff of relevant medical or behavioral conditions
- Support the faith-based and character development goals of Apogee LA
9. Photography & Media
Apogee LA may take photos or videos during activities for internal communication, promotional materials, or community sharing.
Your child’s image will not be publicly used for advertising without separate written consent.
10. Payments & Refunds
- Fees are disclosed at enrollment.
- Payment terms are agreed at checkout.
- Refund Requests
Refunds may be requested by submitting a written request via email to: [email protected]
Eligibility for Refunds
- Refund requests must be submitted within [insert timeframe, e.g., 7 or 14 days] of the original payment.
- Refunds will only be considered for:
- Administrative errors or duplicate payments
- Program cancellation by Apogee LA
- Exceptional circumstances at the sole discretion of Apogee LA
Non-Refundable Fees
- Registration fees, deposits, and any fees already applied toward program operations are non-refundable.
- No refunds will be issued for:
- Missed classes or voluntary withdrawal
- Suspension or termination due to violation of the Code of Conduct
Processing
- Approved refunds will be processed within [7–14 business days].
- Refunds will be issued using the original method of payment unless otherwise agreed.
Apogee LA reserves the right to review and approve or deny all refund requests at its sole discretion, in compliance with applicable California law.
11. Educational Purpose
Apogee LA provides educational and character development programming only.
It does not provide medical, psychological, legal, or therapeutic services.
No guarantees are made regarding academic or personal outcomes.
12. Dispute Resolution
Any disputes arising from participation shall be resolved through binding arbitration under the Federal Arbitration Act.
Class or representative actions are not permitted.
13. Governing Law
This Agreement is governed by the laws of the State of California.
Venue for any permitted court action shall be Los Angeles County, California.
14. Agreement
By enrolling your child in Apogee LA, you:
- Confirm parental authority
- Acknowledge assumption of risk
- Agree to release and indemnification provisions
- Accept these Terms in full
